1. Acceptance of Terms
By accessing or using Abflug.cloud ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
Abflug.cloud is operated by Emanuele Bettoni, based in Austria.
2. Service Description
Abflug.cloud is a multiplayer position-sharing service for flight simulator enthusiasts. The Service allows users to:
- Share their aircraft position in real-time
- View other pilots' positions on a map
- Coordinate group flights
The Service is NOT:
- An official air traffic control system
- Affiliated with IPACS, Aerofly FS, or any flight simulator company
- A substitute for real-world aviation procedures
- Guaranteed to be available 24/7 (especially during beta)
3. User Accounts & API Keys
Registration:
- You must provide a valid email address
- You must be at least 13 years old
- One account per person
API Keys:
- Your API key is like a password - keep it secure
- Do not share your API key with others
- You are responsible for all activity under your API key
- Report compromised keys immediately to [email protected]
Account Security:
- Choose a strong password
- Do not share your login credentials
- Notify us immediately of any unauthorized access
4. Acceptable Use Policy
You agree NOT to:
- Use the Service for any illegal purpose
- Impersonate other pilots or use offensive callsigns
- Attempt to overload or disrupt the Service (DoS attacks)
- Reverse engineer the Service
- Scrape or harvest data without permission
- Use automated tools to create fake traffic
- Violate rate limits (currently 60 requests/minute)
- Harass, abuse, or harm other users
Violations may result in:
- Warning
- Temporary suspension
- Permanent account termination
- Legal action (in severe cases)
5. Beta Service & Availability
Current Status:
The Service is in BETA. This means:
- Features may change without notice
- Downtime may occur
- Bugs are expected
- Your feedback helps us improve
No Guarantees:
- We do not guarantee 100% uptime
- We may modify or discontinue features
- We may suspend Service for maintenance
- We will try to notify users of planned downtime
6. Free Tier & Paid Services
Free Tier (Beta):
- Currently, all features are free during beta
- Subject to fair use limits
- May be throttled if excessive usage detected
Future Paid Plans:
When launched (target: Q1 2026):
- Pricing will be clearly displayed
- You will not be charged without explicit consent
- You can cancel subscriptions at any time
- Refunds handled case-by-case (contact support)
7. User Content & Data
Your Data:
- Flight position data (lat/lon/altitude)
- Callsign (if provided)
- Email address
Data Ownership:
- You own your data
- We store it to provide the Service
- We may use aggregated/anonymized data for analytics
- We will never sell your personal data
Data Retention:
- Active flight positions: 5 minutes after last update
- Account data: Until you delete your account
- You can request data deletion anytime

8. Intellectual Property
Abflug.cloud owns:
- The Service, code, and infrastructure
- The "Abflug" name and branding
- Documentation and website content
Third-Party Components:
- Rewinger uses components from "Aircraft Tracker" by Jugac64
- Auth0 authentication service (see Auth0 ToS)
- Cloudflare infrastructure (see Cloudflare ToS)
You retain:
- Rights to your callsign and flight data
- Rights to feedback/suggestions (but grant us license to use)
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
The Service is provided "AS IS" without warranties of any kind. We are not liable for:
- Service interruptions or data loss
- Crashes of your flight simulator
- Conflicts with other pilots
- Inaccurate position data
- Any direct, indirect, or consequential damages
In simple terms: Use the Service at your own risk. We're building something cool, but we can't guarantee perfection (especially in beta).
10. Third-Party Services
The Service integrates with:
By using Abflug.cloud, you also agree to these third-party terms.
11. Termination
You can:
- Close your account anytime via settings
- Stop using the Service without notice
- Request data deletion
We can:
- Suspend accounts for ToS violations
- Terminate Service with 30 days notice
- Remove content that violates these Terms
Upon Termination:
- Your access ends immediately
- Your API key is revoked
- Your data will be deleted within 30 days (unless legally required to retain)
12. Changes to Terms
We may update these Terms from time to time. Changes will be:
- Posted on this page with a new "Last Updated" date
- Emailed to registered users (for material changes)
- Effective 14 days after notification
Continued use after changes = acceptance of new Terms.
If you disagree with changes, stop using the Service.
13. Dispute Resolution
Governing Law:
These Terms are governed by the laws of Austria, without regard to conflict of law principles.
Jurisdiction:
Any disputes will be resolved in the courts of Graz, Austria.
Informal Resolution:
Before legal action, please contact us at [email protected] to resolve the issue.
14. Miscellaneous
Entire Agreement:
These Terms, together with our Privacy and Cookie Policies, constitute the entire agreement.
Severability:
If any provision is found invalid, the rest remains in effect.
No Waiver:
Our failure to enforce any right doesn't waive that right.
Assignment:
You cannot transfer your account. We can transfer our obligations.
